Bill criminalising instant triple talaq passed in Parliament

New Delhi – On 30th July, Parliament approved a Bill that makes instant triple talaq a criminal offence after the contentious legis-lation was passed by Rajya Sabha.

With Rajya Sabha now approving it, the practice of instant divorce by Muslim men will be punishable by a jail term of up to 3 years. Since it has been signed by the President, the Bill will replace an ordinance promulgated on 21st February to the same effect as the Bill.

To the Leader of Opposition Ghulam Nabi Azad, who termed the Bill as a politically motivated move to destroy Muslim households with domestic fights, Ravi Shankar Prasad, the Union Law Minister, said the Congress leader should think why his party could never win majority following the peak of 400-plus seats it won in 1984.
The law was not being brought due to the Supreme Court ruling of 2017 declaring instant triple talaq, unconstitutional. He said he cannot leave women in lurch, who have been divorced by triple talaq via WhatsApp or other such means. “When the Muslim world is trying to reform, why can’t a Democracy do the same ?”, Ravi Shankar Prasad asked.
