Only members of the Bar Council can become members of the Waqf Board !

Supreme Court decision quashes Manipur High Court order

New Delhi – The Supreme Court has ruled that only an active member of the State Bar Council can become a member of the State Waqf Board. To become a member of the Waqf Board, the person concerned must be a Muslim and hold an active position as a member of Parliament, State Legislative Assembly or Bar Council.

Mohammed Feroz Ahmed Khalid was appointed as a member of the Manipur Waqf Board in February 2023. After becoming a member of the Bar Council in the December 2022 elections, he joined the Waqf Board. He replaced the person who lost in the Bar Council elections.

The High Court had upheld Khalid’s appointment. The court had said that it was not clear in the law that his expulsion from the Bar Council would terminate his membership of the Waqf Board.

On this, the Supreme Court said that if the membership of the Bar Council is terminated under the Waqf Act, then the membership of the Waqf Board will automatically be deemed void.
